GENERAL TERMS AND CONDITIONS OF USE OF THE SITE

Preamble
The purpose of the "www.maison-barbes.com" website (hereinafter referred to as "the Site"), published by Maison Barbès, is to provide information about our hotel Maison Barbès, located at 4 rue Bervic, 75018 Paris (hereinafter referred to as "the Hotel"), and to enable you to book rooms and additional services at the Hotel online.
These general conditions of use (hereinafter "GCU") govern access to and use of the Site by any person (hereinafter "User(s)"). The User undertakes to comply with the GCU, which Maison Barbès reserves the right to modify at any time. The User is therefore advised to refer regularly to the latest version of the GCU available on the Site.
The General Terms and Conditions of Sale (hereinafter referred to as the "GTCS"), which can be accessed at the foot of the Site page, apply to any person wishing to book a room(s) and any additional services at the Hotel, in addition to the GTCS.
1 - ACCESSIBILITY OF THE SITE
The Site is accessible from any device connected to the Internet. The User is solely responsible for the installation, operation and maintenance of the technical equipment required to access the functionalities of the Site. Maison Barbès may not be held liable if the Site proves to be incompatible or malfunctions with certain software, configurations, operating systems or equipment of the User.
2 - PERSONAL DATA
The personal data that Maison Barbès may collect and process in the context of the use of the Site by any person is processed in accordance with the amended French law of 6 January 1978 and the European Regulation n°2016/679/EU of 27 April 2016 known as the "RGPD" and in accordance with the Maison Barbès Privacy Policy: https://www.maison-barbes.com?open=privacy-policy

Any validation of a reservation on the Site implies the acceptance by the Customer of all the conditions for the processing of his/her personal data, without restriction or reservation.
Processing of personal data in the event of a reservation being made on the Site:
In order to take into account and process bookings on the Site, Maison Barbès necessarily requires the Customer's name, e-mail address and payment details.
On an optional basis and only if the customer agrees to provide this additional information, Maison Barbès may also collect the following data in order to be able to contact the customer more easily and/or offer him/her a more personalised service: first name, telephone number, nationality, and/or any additional information that the customer may wish to provide for the purposes of his/her stay at the Hotel.
The above data is collected and processed in connection with the conclusion and performance of the contract between Maison Barbès and the customer, for the purpose of processing the order and for the purposes of any ensuing exchanges.
Maison Barbès is also likely to use this data within the framework of the commercial relationship that may result from exchanges with the customer, and in the legitimate interest of Maison Barbès to keep an up-to-date database of its customers and prospects.
This personal data is intended for use by Maison Barbès teams for the aforementioned purposes and, where applicable, by its subcontractors. It is kept for the time required to fulfil the aforementioned purposes as specified in the Maison Barbès Privacy Policy: https://en.maison-barbes.com?open=privacy-policy, subject to the applicable statute of limitations. It may be transferred outside the EU by Maison Barbès subcontractors. Maison Barbès ensures that all its subcontractors carrying out data transfers outside the EU offer a level of data protection equivalent to that imposed by the RGPD.

4 - INTELLECTUAL PROPERTY AND OTHER RIGHTS ATTACHED TO SITE CONTENT
The Site and all elements of any kind that it may contain (including texts, graphics, posters, videos, sound content, images, logos, trademarks, various creations, software, databases, etc.) are protected or likely to be protected by intellectual property and/or third party rights. 5 - USER BEHAVIOUR WHEN USING THE SITE
Commitments of the User:
If in everyday life we are all required to respect the rules of usage and decorum, we ask all Users to do the same when using the Site.
In this context, the User of the Site undertakes to comply in all circumstances with the rules and obligations as described in the GTC, and more generally with all obligations resulting from French and/or international provisions in force.
In particular, the User undertakes the following:
- To respect the rights of others of all kinds, including in particular personal rights (such as the right to an image, the right to privacy) and intellectual property rights.
- To respect the image and reputation of Maison Barbès, as well as the persons and works referred to on the Site, and not to make any statements and/or take any action whatsoever that may damage the image, reputation and, more generally, the interests of Maison Barbès and/or the aforementioned persons and works.
- Not to use the Site for purposes other than those for which it is intended, and in particular not to use it for commercial purposes and generally not to offer products and services for direct or indirect remuneration.
- Not to hinder or disrupt, in any way whatsoever, access to and/or the proper operation of the Site.
- Not to violate or attempt to violate the security and/or integrity of the Site and/or any or all of its components (in particular software).
- Not to resell or make available to a third party and/or other Users, for a fee and/or free of charge, all or part of the Site.
- Any advertising, promotional or sponsorship message remunerating the User in any form whatsoever is prohibited.
- Any use of the Site must also comply with netiquette (rules and measures in force on the Internet) and any charters and recommendations of any authorised authorities relating to reasonable behaviour and good conduct on the Internet.
Liability and compensation:
The User is solely responsible for his or her use of the Site, his or her actions on the Internet, and more generally for complying with these terms and conditions (and the GTC), and with the applicable standards, and Maison Barbès may under no circumstances be held liable in respect of the foregoing.
Consequently, the User shall in particular take all precautionary measures required to :
- protect and keep secret his/her personal data and booking references, and undertakes not to divulge them in any form whatsoever.
- prevent any use of its personal data and booking references by unauthorised persons or any infringement of the law
- protect their data, software and hardware against any viruses circulating on the Internet (in particular by keeping their anti-virus software up to date and avoiding downloading and/or opening documents and/or messages from dubious or unknown sources).
In addition, the User irrevocably undertakes to guarantee and indemnify Maison Barbès against any recourse, claim or demand from third parties of any nature whatsoever (in particular against any complaint or request from third parties), resulting from the use of the Site. non-compliant with these conditions, violation of the T&Cs, CGV, or the rights of others, public order, and more generally all applicable standards, and undertakes to bear the costs and attorneys' fees. and/or related advice as well as any penalties, particularly financial, which could be pronounced against Maison Barbès, without prejudice to any damages and interest that Maison Barbès could claim.
Maison Barbès declines all responsibility in the event of loss, theft or illicit use of the User's personal data and reservation references, as well as in the event of damage resulting from a computer virus and/or which may be caused to their data, their software or its hardware, as well as in the event of use of the Site and services not in compliance with these terms and conditions of the Site, as well as in the event of use of the Site and/or services contrary to applicable standards.
6 – GUARANTEE – SITE AVAILABILITY
In order to enable harmonious technical operation of the Site, certain technical constraints must be respected by Users.
Due to the constant technical evolution of the Internet network in this area, these constraints are likely to be modified during the execution of this contract.
Maison Barbès strives to keep the Site accessible 7 days a week, 24 hours a day, but undertakes no obligation in this regard.
Maison Barbès may therefore interrupt access to the Site, without notice, in particular for maintenance and upgrade operations, or for any other reason, particularly technical.
Maison Barbès is in no way responsible for these interruptions and any consequences that could result for the User or any third party.
Please note that Maison Barbès may terminate or modify the characteristics of the Site at any time, without notice.
Furthermore, the User declares and guarantees that he is perfectly familiar with the characteristics and constraints of the Internet, and in particular that the transmissions of data and information on the Internet only benefit from relative technical reliability, these circulating on heterogeneous networks with diverse characteristics and technical capabilities, which disrupt access or sometimes make it impossible.
The User accepts the fact that Maison Barbès or its suppliers cannot under any circumstances be held responsible for any material and/or immaterial, direct and/or indirect damage of any nature whatsoever, resulting from the use or inability to use the Site.
Unless otherwise required by law, Maison Barbès is not responsible and cannot be held responsible in any way whatsoever, concerning the following elements, without this list being exhaustive:
- operation of software,
- transmission of all data and/or information on the Internet,
- case of force majeure according to the interpretation of the French courts and tribunals,
- case of interruption of access networks or accessible via the Site,
- failure of reception equipment or telephone lines,
- computer virus circulating on the Internet and which could affect the Site,
- interruption of Site activity.
Furthermore, any non-compliant use of the Site is at the User's own risk and Maison Barbès will not be responsible for any damage or loss of data suffered by its equipment.
Maison Barbès cannot be held responsible in the event of legal proceedings against the User and/or their employees due to use of the Site.
The User is responsible towards Maison Barbès and/or third parties for any material and/or immaterial and/or direct and indirect damage of any nature whatsoever caused by the User when using the Site.
It is up to the User to take all appropriate measures to protect their own data and/or software from contamination by possible viruses circulating on the Internet.

8 – APPLICABLE LAW – DISPUTES – MEDIATION
Applicable law and handling of complaints
These T&Cs are subject to French law. Any dispute relating to the application, interpretation, or execution hereof will be subject to the jurisdiction of the French courts. The Client and Maison Barbès will first endeavor to seek an amicable resolution. To this end, the Customer must first inform Maison Barbès of the subject of their complaint by registered letter with acknowledgment of receipt to the following address: Maison Barbès - 4 rue Bervic, 75018 Paris.
Mediation
In accordance with article L. 612-1 of the Consumer Code, within one year of his written complaint, the Customer benefits, subject to article L.152-2 of the Consumer Code , the ability to submit a request for amicable resolution through mediation, to:
